Appeal from trial term, Erie county. Action by Harvey J. Hurd and another against George Wing. From a judgment of the supreme court affirming a judgment for plaintiffs in the municipal court, defendant appeals.

This action was commenced in the municipal court of the city of Buffalo, where judgment was rendered in favor of the plaintiffs. An appeal was thereupon taken to the supreme court j where another trial was had, with the same result. It- appears that, the plaintiffs, who are lumber dealers, sold a quantity of. lumber to • one Edson B. Sawdy between December 9, 1895, and March 25, 1896. This lumber was delivered to Sawdy upon certain premises in the city-of Buffalo, whereon he was erecting two houses, and the bill there-for amounted to the sum of $1,345-.91.
