This is a writ of error to the Court of Common Pleas of Lancaster county. The matter came- before the court on a feigned issue, directed to try the question, whether an execution, issued by the plaintiff in error, against a certain Jacob Mayer, jr., was'entitled to be first paid out of the money raised by the sheriff, on the sale of the personal property of the said Jacob Mayer, jr.
