This suit was instituted on the second Junte, 1840, and was Before the late Supreme Court in May, 1843. The report of the proceedings had up to that period, is found in 4 Robinson’s Reports, p. 445 et seq. The protracted and useless litigation which has signalized this cause was noticed in a very appropriate manner by the court, without, however, producing any result as to the litigants.
