This application by the petitioner, Maria A. Turcios, for leave *647to file a late notice of claim, is determined as hereinafter provided.
On June 20, 1994, the petitioner went to the Nassau County Medical Center (NCMC) for the labor and delivery of her second child. On that date, the child was born by normal vaginal delivery. However, the petitioner suffered a laceration to her perineum which was diagnosed as a third degree laceration by Dr. Vinette Greenland, the treating obstetrician and employee of NCMC who allegedly repaired it at that time.
