RIVES, Circuit Judge.

In an action brought under the Declaratory Judgment Act, 28 U.S.C.A. § 2201, and Section 10 of the Administrative Procedure Act, 5 U.S.C.A. § 1009, the district court entered a final judgment that the plaintiff-appellee be released from custody by the defendant and “that the defendant, Edward P.
