Rosette Aubert, a free woman of color, in her own right and as tutrix of her minor children, asks that the heirs of Pierre Aubert, be compelled to execute his will and to pay over to her the legacies it contains in her favor *105and in favor of her said children. Marguerite Aubert, one of the heirs, has joined in the prayer of the petition for the execution of the will, and claims from her co-heirs the legacies made to her.
