OPINION
JAMES, Justice.
This is an appeal by the plaintiff from an instructed verdict in favor of defendant. We reverse and remand.
Plaintiff-Appellant John D. Rowe brought this suit against Defendant-Appel-lee J. Gordon S. Harris based upon a written construction contract, alleging that Harris had breached said written contract to Plaintiff Rowe’s damage in the amount of $6479.77; and in the alternative that Harris was liable to Rowe under Sections 17.46 and 17.50 of the Business and Commerce Code (commonly called the Texas Deceptive Trade Practices Act) for certain alleged deceptive trade…
