Defendant was indicted and subsequently convicted of possession with intent to distribute and distribution of approximately 1,700 dosage units of lysergic acid diethylamide in violation of section 401 of the Comprehensive Drug Abuse Prevention and Control Act of 1970, 21 U.S.C. § 841(a)(1). Post-trial motions have been filed with the Court seeking a judgment of acquittal pursuant to rule 29 or, in lieu thereof, a new trial pursuant to rule 33 of the Federal Rules of Criminal Procedure.
