Following a jury trial, Nancy Rawlins Tobias was convicted of homicide by vehicle in the second degree,1 failure to yield right of way,2 and driving with an expired tag.3 After a hearing, the trial court denied Tobias’ motion for new trial. Tobias appeals, contending that the trial court erred in denying: (1) her motion to suppress statements; (2) her motion to sever; (3) her motion for mistrial based on error in administering the jurors’ oath; and (4) her motion for mistrial based on a juror’s question in open court.
