This case is before us on plaintiff’s exceptions to a decision of a justice of the Superior Court denying plaintiff’s motion for a summary judgment under the provisions of Chapter 1343, Public Laws, 1929.
So much of said chapter as is pertinent to the questions presented by the exceptions is as follows: “In any action founded on contract express or implied where the plaintiff seeks to recover a debt or liquidated demand in money payable by the defendant, the plaintiff may annex to his writ an affidavit made by himself or by any other person who can swear to the facts of his own knowledge,…
