In an action to recover damages for breach of a commercial lease, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Weber, J.), dated October 23, 2006, as denied its motion pursuant to CFLR 3124 to compel the defendant to comply with certain document demands and to answer an interrogatory and precluded further discovery.

Ordered that the order is modified, on the law and in the exercise of discretion, by deleting the provision thereof which precluded further discovery; as so modified, the order is affirmed insofar as appealed from,…
