The Hasting & Northwestern Railroad Company, desiring to build a railroad across a quarter-section of land owned by plaintiff, instituted condemnation proceedings in the county court of Adams county. From an award by appraisers, duly appointed, an appeal was prosecuted to the district court, where the cause was tried to a jury, and a judgment entered in favor of the plaintiff in the sum of $3,853.50. The railroad company has appealed, and its *521assignments of error will be taken up in the order presented in its brief.
