DAWKINS, J.

Defendant was convicted of murder and sentenced to be hanged. He was unable to employ counsel, and was represented in the court below by an attorney appointed by the court.

The indictment was returned and filed on July 20,11923, and the accused was arraigned and pleaded not guilty on the next day, without the aid of counsel, and thereafter, in the same minute, it is noted that counsel was appointed and the case set for trial on July 24th. On the latter date the case was continued upon verbal motion of defendant’s counsel until July 27th. We think the better…
