ERROR to the circuit court for the district of Columbia, sitting at Alexandria, in an action on the case by Kennedy against Brent, marshal of the district of Columbia, for the neglect of his deputy in not serving a subpoena in chancery, commonly called a chancery attachment, in due time, whereby the plaintiff lost his debt.
