OPINION

NYE, Justice.

This is a workmen’s compensation case. Liberty Mutual Insurance Company, the *339defendant, appealed from an award of the Industrial Accident Board to the Justice Court of San Patricio County, Texas. David Gomez, the plaintiff, appealed from an unfavorable judgment to the County Court of San Patricio County. The case was thereafter transferred by agreement of all parties to the County Court at Law No. 2 in Nueces County, Texas. The trial was to the court sitting without a jury.
