In the District Court of Humacao appellee, plaintiff below, as purchaser at a judicial sale brought unlawful detainer proceedings against appellant, defendant below, for the possession of certain real estate formerly the property of the latter.

The complaint concludes with the following prayer:

“Wherefore, he prays the honorable court to please render judgment, sustaining this complaint in unlawful detainer, and upon the merits thereof to order the defendant to vacate the property referred to in this complaint, and that in case of his failure to comply with said order within a term of twenty…
