The appellant was indicted for murder, convicted of murder in the "second degree, and his punishment fixed at ten years in the penitentiary.

The first assignment is that the court erred in overruling his motion for a continuance. The continuance was sought because of the absence of several witnesses none of whom had been summoned. The bill, as qualified and allowed by the court, shows that" appellant “was indicted January 14, 1911. He was then in jail.
