Appeal from Jefferson Circuit Court. Heard before Hon. John C. Pugh. Action by Mary B. Brown against Birmingham Waterworks Company, for damages for cutting off water supply. Judgment for plaintiff, and defendant appeals.

This is the second appeal in this ease. On the first appeal this court upheld, as valid, the contract which is the basis of this suit.—Brown v. Birmingham Waterworks Company, 169 Ala. 230, 52 South. 915.

One of the principal questions presented on this appeal is whether this court, on the first appeal, was correct in upholding the contract as valid.
