— In a proceeding pursuant to CPLR article 78 to review a determination of the respondent Superintendent of Green Haven Correctional Facility, dated January 23, 1987, made after a hearing, which found the petitioner guilty of misconduct and imposed punishment, the petitioner appeals from a judgment of the Supreme Court, Dutchess County (Patsalos, J.), entered June 12, 1987, which dismissed the proceeding.
