Appellee, Joseph W. Casey, is “self-employed ... in the flea market business,” i.e., he buys used chattels and resells them at a profit. In December 1998, the Gray-son County Board of Education (Board) held an auction of its surplus property. Although Casey did not attend the auction, an unidentified person notified him that he could obtain two used air conditioners simply by coming to Grayson County High School and removing them.
