Mahan, P. J. :

The defendant in error brought an action against the board of commissioners and the-county treasurer of Lincoln county to enjoin the collection of a part of the taxes levied upon his property in the city of Lincoln Center, charging that the board of commissioners, sitting as a board of equalization, had fraudulently, corruptly and oppressively placed an excessive valuation upon his property. A temporary injunction was allowed by the probate court, and, upon the hearing, made perpetual.

There is no evidence in the record of any corruption.…
