The issue in this case is whether a tenant has been constructively evicted when served with a demand for immediate possession by a mortgagee initiating foreclosure proceedings against the tenant’s landlord. The plaintiff, Conference Center Limited, brought an action against its tenant, the defendant TRC — The Research Corporation of New England, seeking damages for the defendant’s allegedly wrongful abandonment of the leasehold premises.
