Appeal from a judgment of the Superior Court of Los Angeles County, and from an order refusing a new trial. The facts are stated in the opinion of the court.

— This action was brought to have determined which of two applicants had the right to purchase from the state a tract of agricultural land situate in Los Angeles County, and known as the north half of section 36, township 6 north, range 12 west, San Bernardino meridian lines.

It is conceded that the thirty-sixth section, of which jihe land involved in the contest is part, belonged to the state; that prior to April, 1872, the township was surveyed and sectionized by the United States, and that the plat of survey was approved and filed in the local United States land-office of the district in…
