Appeal from the Circuit Court of Richland county; the Hon. William H. Green, Judge, presiding. Heard in this court at the October term, 1912.

Upon rehearing of this case the court adopts this modified opinion in lieu of the opinion filed herein on June 27, 1912.

The chancellor in this case sustained a general demurrer to the bill of appellant and entered a decree dismissing it with costs.

It was averred in the bill that appellant and appellee entered into a written agreement, the material provisions of which were, that appellee would supply appellant with natural gas for the sum of $4,000 per year based on appellant’s boiler capacity of four hundred and fifty horsepower so long as appellee should have sufficient gas in its mains at…
