ROBERTSON, Justice.

This is an appeal from the trial court’s order dismissing plaintiff Singer’s action pursuant to defendants Clayton Brokerage and Dial’s plea in abatement. In their plea, defendants contended plaintiff’s action for misrepresentation and deceptive trade practices in connection with futures contracts should be abated because the Commodity Futures Trading Commission, the CFTC, has either exclusive jurisdiction or primary jurisdiction with respect to transactions involving commodity futures contracts such as those pleaded in plaintiff’s petition.
