Appeal by the plaintiff, Cornelius C. Vermeule, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Steuben on the 24th day of September, 1917, upon a decision of the court dismissing the complaint and awarding defendant judgment on its counterclaim after a trial before the court, a jury having been waived.

There can be no doubt but that under the charter of the city of Coming (Laws of 1905, chap. 142, as amd.) the financial affairs of the city are committed to the jurisdiction of the common council. In view. of the result reached in the case it may be assumed without deciding that the board of public works as such had no. authority to contract debts of the character here involved.
