This is an appeal from an order by the El Paso County District Court which dismissed a felony menacing charge against the defendant, Tom Freeman. We reverse the order of dismissal.
On April 29, 1976, an information was filed in El Paso County District Court charging the defendant, in two counts, with second-degree assault, section 18-3-203, C.R.S. 1973, and felony menacing, section 18-3-206, C.R.S. 1973.
