Plaintiff, West American Insurance Company (West), the insurer of a vehicle operated by Diane Butina, a Minnesota resident, settled personal injury claims that had been made against Butina as a result of an automobile accident. The accident occurred in Minnesota while Butina was returning to Minnesota after consuming alcoholic beverages in Hudson, Wisconsin. West then commenced this action seeking contribution or indemnity against defendant, Westin, Inc.
