HENDERSON, Judge.
Appellant was convicted of an assault with intent to murder, and his punishment assessed at confinement in the penitentiary for a term of five years; hence this appeal.
The statement of facts shows that the difficulty, which was the occasion of the prosecution, arose between appellant and prosecutor Brown over a rent contract, or a right claimed by appellant to rent the land of the prosecutor.
