Appeal from an order of the Supreme Court (Hoye, J.), entered October 27, 2004 in Schenectady County, which denied defendant’s motion for summary judgment dismissing the complaint.

Plaintiff left her apartment at approximately 6:00 p.m. on a Saturday evening in February. She approached her car by walking along a sidewalk in her apartment complex, owned by defendant.
