This is a motion by respondent for an award of counsel fees pursuant to section 438 of the Family Court Act.

The thrust of the motion is that the respondent has been subjected to two separate and distinct ungrounded and false support proceedings by his former wife, neither of which resulted in any upward modification. Respondent contends that this was done deliberately to harass and inconvenience him, causing him to expend substantial sums of money to defend himself.
