MEMORANDUM OPINION

DAUGHERTY, District Judge.

This is an action by Plaintiff to recover on an adjuster’s professional liability insurance policy issued to Plaintiff by Defendant. This Court has subject matter jurisdiction by reason of diversity of citizenship and amount in controversy pursuant to 28 U.S.C. § 1332. A non-jury trial was conducted herein on November 6 and 7, 1980, and January 7, and May 27, 1981.
