CHRISTIAN, Judge.

The offense is assault with intent to murder; the punishment, confinement in the penitentiary for nine years.

Sylvester Steen, a negro, had gone to his home in an automobile with his brother, the appellant, for the purpose of removing his personal effects. A quarrel ensued between him and his wife, Haddee Steen, which resulted in Horace Reed, the constable of the precinct, being called to the house.
