The Towns of Norfolk and Walpole, plaintiffs in consolidated cases Nos. 90-11086-MA and 90-11286-MA, brought under the National Environmental Policy Act of 1969 (NEPA), 42 U.S.C. § 4321 et seq., having previously been denied their motion to intervene in consolidated cases Nos. 85-0489-MA and 83-1614-MA (the “Boston Harbor case”), see Memorandum and Order, United States v. Metropolitan Dist. Comm’n, 754 F.Supp. 935 (D.Mass.1991), now move pursuant to Fed.R.Civ.P. 42(a) for further consolidation of the NEPA cases with the Boston Harbor case. The…
