—Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Washington County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

After participating in the family reunion program at Great Meadow Correctional Facility in Washington County, petitioner, an inmate at the facility, was charged with using a controlled substance. The misbehavior report stems from the positive results of two urinalysis tests that indicated the presence of opiates.…
