THIS MATTER comes before the Court on the Defendants’ Motion to Dismiss Mat*229thew “Cody” Graham and Shannon Silversmith for Failure to Timely Serve Them, filed August 16, 2004 (Doc. 9). The Court held a hearing on this motion on April 21, 2005.
