Affirming in part and reversing in part.
Wolfe County sued Miles Tolson, former jailer, and tbe sureties on bis official bond to recover $750, alleged to bave been illegally received by bim as compensation. Tbe circuit court sustained a plea of res adjudicata and tbe county appeals.
In April, 1933, tbe fiscal court fixed tbe annual salaries of tbe several county officers who should be elected in tbe following November to take office in January, 1934. As a “salary” tbe sum of $300 was appropriated for “tbe jailer for beating and lighting tbe court…
