Before proceeding to state the questions presented by this appeal and my conclusions, some preliminary observations may properly be made.
The original petition of the Newark Savings Institution, it must be observed, did not seek relief on the ground of an admitted insolvency, nor upon any statutory or other power of the-court to intervene to distribute its assets as those of an insolvent corporation.
