MESKILL, Circuit Judge:
This is an appeal from a judgment of the United States District Court for the Southern District of New York, Griesa, J., entered on October 30, 1989 after a bench trial, awarding damages for breach of an oral contract to plaintiff-appellee Milltex Industries Corporation (Milltex). In entering this judgment the district court refused to give res judicata effect to a judgment entered in the State of Alabama, Circuit Court of Madison County (Alabama court) on February 22, 1989.
