In an action to recover damages for personal injuries, the defendant New York City Housing Authority appeals from so much of an order of the Supreme Court, Kings County (Battaglia, J.), *768dated April 4, 2007, as denied that branch of its motion which was for summary judgment dismissing the plaintiffs cause of action asserting a violation of Real Property Law § 231 (2) insofar as asserted against it.

Ordered that the order is affirmed insofar as appealed from, with costs.
