This was an action in trespass to try title, filed the 26tli day of August, 1030, by the heirs of Cynthia C. Frazier against Temple Lumber Company, involving a tract of 640 acres of land in Jasper county, patented to Cynthia C. Frazier on the 8th day of March, 1848. Temple Lumber Company answered by general demurrer, general denial, pleas of not guilty, and the several statutes of limitations, and by cross-action in trespass to try title, pleading specially the several statutes of limitations, also by pleas over against its warrantors.
