In an action to recover damages for personal injuries, the plaintiff appeals (1) from an order of the Supreme Court, Nassau County (Daily, J.), entered February 19, 1998, which granted the motion of the defendant Rosemarie Bolte pursuant to CPLR 3216 to dismiss the complaint insofar as asserted against her, and (2), as limited by his brief, from so much of an order of the same court, dated August 3, 1998, as, upon reargument, adhered to its prior determination.
