Appeal by the plaintiff, The Insurance Press, from a judgment of the Supreme Court in favor of the defendants, Montauk Fire Detecting Wire Company and another, entered in the office of the clerk of the county of New York on the 9th day of November, 1904, upon the decision of the court, rendered after a trial at the New York Special Term, sustaining the said defendants’ demurrer to the plaintiff’s complaint and dismissing the said complaint.

The plaintiff brings this action as a stockholder of the defendant corporation to enforce a claim of that corporation against the individual defendants.
