Tony Ambolo, plaintiff in error, in October, 1927, was found guilty by a jury in the criminal court of Cook county of robbery while armed with a dangerous weapon. He was sentenced to the penitentiary at Joliet for an indefinite term and is now there incarcerated. In August, 1930, his counsel applied to the clerk of the criminal court for a transcript of the common law record of his case so that the same could be submitted to this court.
