Montell Rice Meacbam appeals his conviction by the trial court, sitting without a jury, on one count of bribing a public official in violation of Penal Code, section 165, a felony.

Appellant was charged with five counts of bribery of a city councilman (Pen. Code, § 165) and was charged in the sixth count with bribery of an executive officer (Pen. Code, § 67). The court found him guilty of counts I through V and not guilty as to count VI. Appellant was granted a new trial as to counts I through IV and those counts were thereupon dismissed.
