The original bill in this case was for the partition of land, between tenants in common, and for the cancellation of a contract for the sale of the land, executed in the name of one of the co-tenants to the appellee, Elmira Stearns. It was filed on November 27, 1882, by Storm A. Becker, as one of the tenants in common, against the other tenants in common, and against said Stearns, and the appellee John Carne Jr. The only allegation in said bill having any reference to Carne is, that he “claims to have some interest in said land, which said ' interest, if any he has, is by way of purchase of…
