The question for decision in this case arose upon the report of the appellee for final settlement of the estate of which he was administrator. The personal estate of the deceased, according to the appraisement, amounted to one hundred and eleven dollars and seventy cents, and this was taken by the widow at the appraised value. The deceased also ■owned a tract of land, on which there was a mortgage executed by him in his lifetime. This was sold by the administrator :and the widow jointly.
