Plaintiff in this action is a resident and voter of the Fourth Senatorial District in the State of Hawaii. He asks that this court permanently enjoin John A. Burns, the Governor of Hawaii, from appointing a senator to fill the vacancy in the state senate resulting from the death of Larry N. Kuriyama, a nominee for a Fourth District senate seat, just prior to the general election of 1970. Under the decision of the Supreme Court of Hawaii in State ex rel. Karbara v. Gill, 477 P.2d 625 (1970), such an appointment would create a term of office lasting until the general election in…
