1Opinion of the CourtRichardson, J.

On the 8th day of September, 1875, John T. Evans, senior, of Alexandria, departed this life intestate, seized of a large estate, real and personal, the latter amounting to about $100,000. He left no widow, but did leave three daughters surviving him—namely: Virginia Stewart, Mary O. Watkins, *726and Ann Maria Ellis, all of whom resided in the State of Virginia at the time of their father’s death. There was a fourth child—a son—John T. Evans, junior, who had grown to manhood, married, but had no children, abandoned his wife and home, and left Virginia a number of years prior to his father’s death.
