The Board of Education of Union Free School District No. 6 of the town of Cortlandt, Westchester county (hereinafter referred to as district No. 6), brings this action against the Board of Education of Union Free School District No. 7 of the town of Cortlandt, Westchester county (hereinafter referred to as district No. 7), for the purpose of having chapter 516 of the Laws of 1898 declared unconstitutional and void, and incidentally to collect from the latter district the sum of $3,000 in damages by reason of the operation of said statute.
